Shelby County Attorney Rholes indicted on driving while intoxicated, reckless driving charges
Shelby County Attorney Gary Rholes has been indicted by a Shelby County Grand Jury on charges linked to his Decembrer 2018 arrest for drriving while intoxicated.
A grand jury indicted him in November on the misdemeanor charges of driving while intoxicated - 2nd, Class A misdemeanor, and for for reckless driving, misdemeanor Class B. Since the indictments were misdemeanors, court records indicate they were referred to the County Court of Shelby County.
That was done on Tuesday, Dec. 17, when the grand jury presented the same indictments to the Shelby County Clerk in orders signed by 123rd District Judge LeAnn Kay Rafferty. Those papers were filed on Wednesday, Dec. 18.
The driving while intoxicated indictment alleges on Dec, 18, 2018 Rholes was driving intoxicated in an automobile with an open container of an alcoholic beverage. The document said there was another container in the vehicle which had been opened and contained alcohol.
On the reckless driving charge, Rholes was indicted for reckless driving, Misdemeanor Class B. The indictment alleges on Dec. 18, 2018 Rholes recklessly drove a vehicle in a willful or wanton disregard for the safety of person or property.
The indictment further states this was done by driving on the wrong side of the road toward oncoming traffic and at an unsafe speed swerving between lanes of traffic and into a ditch.
